Did you know the police begin building their case against you at first contact? The conversation may seem neutral enough, sometimes even friendly. You may think you are defending yourself. You may even believe you can convince the officer not to arrest you. You may believe your statements can’t be used against you if you were not read the Miranda warnings. But there are exceptions to every rule, including the Miranda rule. Police officers are schooled in the best ways to obtain information, and cooperation, from people. They may try to get your permission to search your person, vehicle or home. You do not have to give this consent. A polite refusal is best.

 

Even if you have said things you wish you could take back, or allowed the police to search your property, it still may be possible to undue the damage. But only if you don’t wait!
